HAVER and BOECKER is not the architect of the building; per this site, they were only involved in the making of the exterior glass cladding that makes up its façade. The real author and architect of the building is Hadi Simaan Architects. Qatar does not provide Freedom of Panorama, so this image cannot be kept unless either FoP is introduced there or explicit commercial license permission from Hadi Simaan Architects is granted. Photos of TuX dolls and toys[edit]

These images have been deleted (by me) per Commons:Deletion requests/File:Accord Computer Europe office12.jpg. However, most uploaders have not been notified about the requenst. The uploaders were therefore not able to comment on the DR. In addition, the DR was not listed on the image file pages. The layout of the DR was confusing and I assumed the file names were scratched by mistake. After a comment on my userpage I decided to undelete the files and to nominate them again, with a notification to all uploaders, in order to make a broader discussion possible.

The original DR, as initiated by A1Cafel[1] and commented by Someone Not Awful and IronGargoyle was closed by myself deleting all files, but actually I should have notified all uploaders. Therefore I decided to open a new request.

 Keep I have looked to all of the above images where TuX is depicted, images which are notified to be deleted. First of all it is not about the toy itself, but about a mascotte of an open source or free license user communities. For Wendy the Weasel is it about the social live amongst stuffed mascottes, which is surely not about toys. So, I believe the US toy copyright law would not be applicable in those cases. I also object against deleting:
1) Some of the designs are that close to the original Tux design, that they don't pass a threshold of originality (German 'Schöpfungshöhe'). They simply took the 2D design of the Tux, dropped it into a design program and modified just a few little things. Which is totally fine, but it doesn't allow them to claim copyright, because it is not a separate artwork.
Meanwhile, the 2D design of Tux is public domain.
2) Let's say, in some cases the original 2D Tux image has been modified enough, so that the 3D model is copyright-protected. Then, I would argue, the protection concerns the design itself. It doesn't protect images of a product, based on the design. S60W79 (talk) 20:39, 26 April 2024 (UTC)[reply]

I uploaded this file, and honestly, I think you’re right. Based on the video it’s from, you seem to be correct; the Thai government and Parliament is infamously unfriendly to the public domain.
I won’t support keeping the file or deleting it, and prefer to recuse myself from the final descion. However, I think if it were to be deleted, we can replace it with a different picture already on Commons (or upload new public domain photos from elsewhere) that represents Pita’s time as an MP before the 2023 election. I'd argue that most- if not all- of these cans cross the line into COM:PACKAGING-related copyright violation. However, I appreciate that the artwork visible on some is simple or minimal, so they may be on the edge, hence I've nominated them here rather than simply tagging as copyvio.

Note that even in some cases that might otherwise be "de minimis", the appearance of the can itself is clearly the subject and focus of interest, rather than simply something that happens to appear in the photo.

For me the same applies here: "Before taking and uploading the image I also asked myself if the object or the print could pass the threshold of originality. I (obviously) didn't think so. The can is just a cylinder. The paint largely is just purple with a few letters in it. The "FANTA" writing on the can is about as original as any other textlogo. The grapes themselves are very simple shapes done with a surprisingly low resolution. They are not great art that is worth protecting, but rather a bunch of simple shapes that are arranged in a simple way [...] Regarding the threshold of originality: Compare the design of the can in the image to Pepsi Mango. If not deleted by the hoster the artwork on the beverage cab can be found here. In my opinion there is a clear difference between the simple design (from my point of view PD level) and a more complex and artistic design of the can."

The copyrightability of the label does not matter: "We need not, however, decide whether the label is copyrightable because Ets-Hokin's product shots are based on the bottle as a whole, not on the label. I'd like File:Fanta grape 325ml can-front PNr°0882.jpg to be withdrawn from consideration, as- regardless of the arguments above- I wouldn't have nominated it again if I'd been aware it had already been discussed and kept.
FWIW, that was definitely one of the cases closest the edge for me in the first place.
That said, whether or not your image should be kept for other reasons, I'm not 100% sure the case you mentioned is relevant here.

The images I saw seem to confirm this.
However, with the various photos of Fanta cans (including yours?), it's fairly clear that the majority were taken to illustrate the (varying) label designs rather than the aesthetics and design of the otherwise generic can design itself.

Nominating all images as violating the copyright law of B&H. Bosnia and Hercegovina does not permit commercial Freedom of Panorama, and these images lack commercial Creative Commons licensing permission from the heirs of the architect. The building dates to 1980. Interior architecture as well as the crucifix tower are also included here. One past deletion request is Commons:Deletion requests/File:Mostar-cathedral06474.JPG.
