Creatur unknown. Even if rajanews licenses under CC it is not their right to upload photos from their sites. Nicola (talk) 10:41, 24 April 2024 (UTC)[reply]

Knowledge of the creator is not required. If the creator works for Rajanews or if the creator grants rajanews the CC-license, they have the right to upload the photo.
Do you have any indications that Rajanews doesn't have the license? --Eulenspiegel1 (talk) 11:09, 24 April 2024 (UTC)[reply]
But is not clear if the creator works for did. Too many "ifs".
We have to have indications that Rajanews has the right to upload this photo - not the other way round. --Nicola (talk) 11:14, 24 April 2024 (UTC)[reply]
Please see in this subjekt the specialpage of the Wikipedia in germany, because the request by user@Zartesbitter there was: the licence ist no violence of the law. Triomint69 (talk) 11:15, 24 April 2024 (UTC)[reply]
This question has to be cleared HERE, not in the German speaking Wikipedia. And what is the "specialpage"? Diff? --Nicola (talk) 11:29, 24 April 2024 (UTC)[reply]
1-2 users in de.wiki wanted to remove this picture from this article. First the cc license was questioned then the picture was removed because of "rajanews = bad"??
Both removals where opposed from several editors.
Now they try to remove the picture altogether as they had no success in de.Wiki.
  • Keep the picture
,as this will not only affect de.wiki but also several other wikis. The pictures show no sign of alteration as far as I can see. 176.4.199.66 11:50, 24 April 2024 (UTC)[reply]
The mentioned specialpage is the de.Wiki "license review" page: Result: license is OK. 176.4.199.66 11:55, 24 April 2024 (UTC)[reply]
... and the result on this specialpage licence review (page Urheberrechtsfragen) is based on good arguments there and should be known and to be noticed here too. The description "creator unknown" ist the regular procedere in this kind of case, specials in areas like here. Triomint69 (talk) 15:55, 24 April 2024 (UTC)[reply]
keep, a nonsense request due to some nonsense discussions on German wiki. The license is OK, the picture fits the content of the article. With these arguments we would have to delete the most pictures of the most dictators and the most documentaries on dictatorship regimes as they mostly are published by a dictatorship agency. Nonsense, sorry keep anyway. -jkb- (talk) 12:51, 24 April 2024 (UTC)[reply]
This is not the point - the point is, that we do not know, who the creator is and if he or she licensed it. Until now it is only a claim. It has nothing to do with political implications. --Nicola (talk) 12:58, 24 April 2024 (UTC)[reply]
+1 delete it. Zartesbitter (talk) 13:39, 24 April 2024 (UTC)[reply]
Rajanews states on the relevant website: “Content on this site is licensed under a Creative Commons Attribution 4.0 International license”. If no strong reasons can be given, then it can be assumed that Rajanews has the rights to the image. Keep -- Hans Koberger (talk) 14:32, 24 April 2024 (UTC)[reply]
By all accounts, Raja News was founded by Meghdad Nili, the son-in-law of Ebrahim Raisi, the current Iranian president. The CEO is Nili's brother. Given this degree of closeness to Iran's centre of power, the assumption that Raja News has the ability to effectively assert a CC licence seems reasonable to me. Keep. Andreas JN466 20:15, 24 April 2024 (UTC)[reply]
Keep. This image is clearly published under the CC licence by rajanews, so it's perfectly fine. It would be nice if we knew the name of the photographer, but it is not a requirement. BTW there are about 2.7 million images on Commons with Unknown author so it's really not that uncommon. --MatthiasGutfeldt (talk) 14:43, 24 April 2024 (UTC)[reply]

  •  Comment Image comes from IRNA[2], reposted by other Iranian media.[3][4][5] — kashmīrī TALK 15:25, 24 April 2024 (UTC)[reply]
I can only translate that the post of rajanews was published on 9:03 p.m. but which date? It it is 1st april 2024 (or later) than it would be a clear copyviolation of rajanews. If the date signature is clear I'll change from keep to delete.
But the strange think (on both pages) is the left edge of this image, because you can see an completly other images. So this means also for IRNA that this could be a screenshot and not the original image. Alabasterstein (talk) 18:55, 24 April 2024 (UTC)[reply]
FWIW, the rajanews page was first saved on archive.org on the morning of 2 April: [6] (All this tells us of course is that it must have been published before that time, but we don't know when.) Andreas JN466 19:40, 24 April 2024 (UTC)[reply]
Per [7], Ali Naderi, the current head of IRNA, was the editor of Raja News before his move to IRNA in late 2021. Even if the image appeared first on IRNA, these Iranian media outlets are under such close ideological control, so intertwined and aligned in their daily work that I find it hard to believe that Raja News' CC policy would be unknown to IRNA, or something they would want to dispute. Andreas JN466 21:01, 24 April 2024 (UTC)[reply]
  • [8] "Only upload Rajanews images that are from Rajanews photographers (with explicit attribution, usually watermarked). "khamenei.ir", "president.ir", and "Received" images should be uploaded from their source." --Nicola (talk) 16:56, 24 April 2024 (UTC)[reply]
Keep ... in the description of file of the image is included an amendment to conditions of licence with this wording:
"This image may have previously contained a watermark, which has been removed from the image and its author and source attributed in the file page description instead. To use this image, ensure that you comply with its licensing conditions and attribute the original author appropriately."
And it means a special rule of exception for this category of images. The licence is fine and there is no reason to delete. Triomint69 (talk) 19:25, 24 April 2024 (UTC)[reply]
.. and Rajanews never told in the description of an image the name of the author/creator - perhaps is to dangerous for this author/creator in the area with the violence conflics there. Your can read this in the answer of the request (special page de.Wiki "license review"): Rajanews publish never the true name and only the description unknown author. The IRNA date is Gregorian April 1, 2024, 19:33... --Tusculum (talk) 06:15, 25 April 2024 (UTC)[reply]
Thank you. This means IRNA was first. However, there are inconsistencies anyway. See my comment above. Alabasterstein (talk) 06:24, 25 April 2024 (UTC)[reply]
In my point of view you can see the reflection of a window facade on a protruding building on the left edge of the picture, and not a part of another picture. However, the image may have been taken from a video. --Tusculum (talk) 06:37, 25 April 2024 (UTC)[reply]
A reflection with a very straight vertical line although the other vertical lines are not that straight? But also optical it doesn't look like a reflection for me. The concrete facade do not even have the ability to reflect. Alabasterstein (talk) 08:31, 25 April 2024 (UTC)[reply]

  • Delete. Despite a lengthy discission, the community has not been able to establish beyond reasonable doubt that the image is in public domain, hence we must err on the side of caution. — kashmīrī TALK 23:46, 25 April 2024 (UTC)[reply]
In my opinion, in many cases the community cannot definitively determine whether an image is in the public domain. We are generally not lawyers, detectives or prosecutors. We do not know any possible contracts, compensation etc. between the photographer and IRNA or between IRNA and Rajanews. Rajanews guarantees that the image is under free license. As long as there is no accurate indication of legal irregularities, there is no reason to delete the image. -- Hans Koberger (talk) 07:23, 26 April 2024 (UTC)[reply]
Rajanews's CC tag should be disregarded IMO, or at least construed as applying only to their own generated content. It certainly does not apply to all content – e.g., logotypes of Facebook, Instagram, Twitter, content of advertisements they run, and so on, are not under CC. Additionally, Rajanews carries adverts of sites with pirated content (e.g., cooldl.net), which sort of exemplifies they attitude to copyright. Frankly, I doubt Rajanews is at all willing to pay for artwork or even employs a photographer. — kashmīrī TALK 10:57, 26 April 2024 (UTC)[reply]
We are not talking about logos of Facebook, Instagram, Twitter, content of advertisements they run, etc. This image, used by numerous language versions of Wikipedia, should IMO only be deleted based on clear, proven facts. I don't see it at the moment. -- Hans Koberger (talk) 12:03, 26 April 2024 (UTC)[reply]
According to the German legal situation and according to Paragraph 10 of the Copyright Protection Act (https://www.gesetze-im-internet.de/urhg/__10.html), a rebuttable presumption suggests that the specified author or publisher in the absence of an called actor in the legal sense, the claimed also has the licence until a mistake has been proven. It must be clarified whether this German law applies and whether there may be similar regulations in another applicable legal system. Triomint69 (talk) 12:26, 26 April 2024 (UTC)[reply]
In addition to my previous edit of myself, it should also be noted that this is a question of international private law with regard to copyright. In this respect, the protection principle of the country must also be observed, in this case syria. Triomint69 (talk) 13:01, 26 April 2024 (UTC)[reply]
Service: Commons:Copyright rules by territory/Syria/de. --Tusculum (talk) 13:25, 26 April 2024 (UTC)[reply]
Thanks for the service (german translation). With regard to the original page in English of WP Commons published here now (Commons:Copyright rules by territory/Syria), it should be noted that in the overview there have no reference to no indication of the invalidity of the license can be found. Only: The question remains, the free license also exists in the USA and why this is necessary... Triomint69 (talk) 14:00, 26 April 2024 (UTC)[reply]
The head of the state news agency IRNA used to be at Rajan News, and Raja News was founded by the son-in-law of Iranian President Ebrahim Raisi. The assumption that Raja News steals images from IRNA seems to me about as plausible as the assumption that RT would steal his images from TASS. Triomint69 (talk) 14:32, 26 April 2024 (UTC)[reply]
Quite. If Russia Today hosted a picture and asserted a CC licence, but the same image had appeared on TASS an hour before, would we question it? Or would we just say it's the Russian government media machine doing its thing? This is much the same. These are autocratic governments and there is much one can say about that but what is relevant here is that they have, and exercise, control. Andreas JN466 18:49, 27 April 2024 (UTC)[reply]
Yes, that's how I see it too. -- Hans Koberger (talk) 05:53, 28 April 2024 (UTC)[reply]
  •  Delete. --Tusculum (talk) 13:27, 26 April 2024 (UTC) What is relevant here is the fact that Rajanews apparently does not have the copyright. That's why the picture is sometimes referenced with IRNA, sometimes with PressTV as a source, and only in individual cases - also with reference to Wikipedia - with Rajanews. In addition, the picture was published on Twitter before Rajanews or more or less at the same time. The fact that Rajanews claims that all the material on its website is under a CC license is just an assertion. And the fact that the {{Template:Rajanews}} explicitly states that you can only use the template to upload images that name the Rajanews photographer speaks for itself (Only upload Rajanews images that are from Rajanews photographers (with explicit attribution, usually watermarked). Almost all images uploaded using the template credit the author in the original source on the website (see Category:Photos from Rajanews.com). --Tusculum (talk) 16:36, 25 April 2024 (UTC)[reply]
PressTV is another Iranian state source. Just like IRNA and Raja News. It's all pretty much the same thing. The idea that Raja News, founded by the Iranian president's "beloved and precious" son-in-law Meghdad Nili and run by his (the son-in-law's) brother Meysam Nili (see [9]), would not have permission to use PressTV content just does not compute for me.
For reference, in addition to being the CEO of Raja News and being the brother of the president's son-in-law, Meysam Nili is described by iranintl.com as "an advisor to the Minister of Islamic Guidance Mohammad-Mehdi Esmaili" and "a shadowy figure with much influence in many government and state bodies including the state broadcaster (IRIB) and the Supreme Council of the Cultural Revolution where he heads the Hijab and Chastity taskforce." (See [10], published yesterday.)
Again, this is not a dude in a basement playing fast and loose with CC licences but a powerful figure at the centre of the Iranian government. When his media outfit, Raja News, asserts they have the right to use and license state TV (PressTV) content, I would believe them. Andreas JN466 23:14, 28 April 2024 (UTC)[reply]
If "dude" or not, if son-in-law or not - this family business and some people's imagination from what might be has nothing to do with copyright regulations and proper licences. --Nicola (talk) 11:29, 29 April 2024 (UTC)[reply]
It looks like the picture comes from IRNA. In your opinion, does what you said also apply to IRNA? -- Hans Koberger (talk) 16:56, 26 April 2024 (UTC)[reply]
Not sure about IRNA, but most Iranian websites don't bother to give credit as Iran is not a member of the Berne convention and there won't be legal consequences for them for that matter. Hanooz 17:42, 27 April 2024 (UTC)[reply]
Thank you for the answer and Rajanews give the information they are the copyright holder, implicitly in the communicated license itself and they never publishes the name of the image. The license seems to be in order, there are no thorough considerations. Triomint69 (talk) 17:10, 26 April 2024 (UTC)[reply]

Malformed AI-generated image; it's intended to depict a style of whistling performed with just the fingers and the mouth, but the AI has put a few random wooden pipes in there. The finger positions also look incorrect. Belbury (talk) 14:36, 24 April 2024 (UTC)[reply]

It seems wrong to me for a mountain whistling language, it looks more like someone making a soft bird call than sending a piercing whistle across mountains. https://www.gettyimages.co.nz/photos/occitan-whistle certainly only shows finger-in-mouth whistles. Dear Peter Christian Riemann (PCR), Flickrreview checks whether the photographer released the rights on the photograph, but it cannot (yet) see if the work depicted in the photograph is still protected by copyright or not. The building is still protected by copyright.
On the file depicting parts of the roof, well that's a point of view, one can see much better the structure of the roof on that file than on the files where the whole chapel is depicted. I won't withdraw the DR on that file.
And on the Pino Musi file: There the whole chapel is depicted in prime focus, if kept, it would likely be the only file of a whole Le Corbusier building in France after it was nominated for deletion. Paradise Chronicle (talk) 17:21, 25 April 2024 (UTC)[reply]
Paradise Chronicle (Diskussion) I don't understand, that your main effort seems to be the extinction of a lot of images which are important for the visual understanding of architecture, thus reducing the quality of Wikipedia as Encyclopedia. Most of these files (uploaded under the Wikipedia articles: Saint Marie e la Tourette and Notre Dame du Haut) sustained for different reasons any deletions since years, despite the surveillance of bots and the supervision of competent users and admins. Everybody who is struggeling in search of exceptions for image-publishing within the limits of French legislation is forced to interpret the code de la propriété intellectuelle (CPI), is bound to a shaky French FoP and has to be regardful towards the Wikimedia rules, which allow commercial usage of files, even if the author has no such usage in mind. Another dramatic handicap for Wikimedia/Wikipedia interests is the existence of the French ADAGP Society, which undermines a European solution and the improvement of FoP. Therefore riding only "No FoP in France" horses and the bureocratic use of "author´s death plus 70 years" as tunnel vision, does not help to develop and broaden worldwide knowledge. In that respect i would argue that the Pino Musi file as derivated work of art (series of photographs) is compatible to French Law and should not be deleted. Files in Category:Chapelle Notre-Dame-du Haut de Ronchamp[edit]

No FoP in France and same as above. One has the mention it is in the PD but this can only be for the photograph and not for the building and the scenery of light.

Paradise Chronicle (talk) 19:46, 24 April 2024 (UTC)[reply]

The photos
show a minor part of the building (altar), are absolutely trivial and non representative for the building as such.
In my view the photo belongs to the de minimis category and shows a technical aspect of how the light is catched. Peter Christian Riemann (talk) 15:05, 25 April 2024 (UTC)[reply]

No FoP in France

Paradise Chronicle (talk) 19:47, 24 April 2024 (UTC)[reply]

Hello User:Paradise Chronicle, the description of the image is as follows: The Serapeum in the Vila Adriana in Tivoli near Rome was an early model for Le Corbusier for indirect lighting. His sketches date from October 1910. He used this type of "periscopic" tool for a diffused incidence of light in the three chapels of the pilgrimage church in Ronchamp. That means, together with a PD-picture from the "Serapeum" I explain the technical precedent of the lighting system in the side-chapels. Those three photos, belong a) to the de minimis category and form together with the other photo of the Serapeum a context of technical knowldege. In this setting of which the work of art is a mere part, the right of the artist (Le Corbusier) is not violated. If we only follow the rules (author´s/creator`s death + 70 years) and do not inteprete the law (which in France allegedly reads: Zero FoP), then WIKIPEDIA loses the potential of a worldwide Encyclopedia. Peter Christian Riemann (talk) 15:43, 25 April 2024 (UTC)[reply]
It says at the top of the category that this: a category of a copyrighted architecture and/or artistic work in public space from a country that does not provide Wikimedia Commons-acceptable freedom of panorama (that permits free licensing of images of such works). Please do not upload more photographs or videos of such works, unless their presence is incidental or trivial to the overall image. The Peugeot files, where the chapel is in the background have not been nominated for example. Paradise Chronicle (talk) 17:03, 25 April 2024 (UTC)[reply]
To me this is a good example of a trivial image: File:Chapelle intérieure de la chapelle de Ronchamp octobre 2019.jpg (see green lines). And what are "Peugeot files"? Peter Christian Riemann (talk) 12:01, 26 April 2024 (UTC)[reply]
With Peugeot files the two files with Peugeot in the filenames are meant here and here. The file you say is trivial depicts a part the believers prays to. And the light coming from the skylight likely symbolizes some sort of the Holy Spirit (or the godsent energy from heaven) or in Le Corbusiers words: the ineffable space. Thats not trivial in my opinion and also quite a popular focus in articles on the chapel like here or here. Paradise Chronicle (talk) 14:03, 26 April 2024 (UTC)[reply]
The altar as such is trivial to the overall well known building of le Corbusier in the context of the Wikipedia article, no matter how and if it is published in other media. The general problem is that tons of photos and drawings are published in books, blogs and magazines of Le Corbusiers work and that thousands of copyright violations of those publications are floating the internet, whereas Wikimedia act as the good guy. The building was completed in 1952 by Le Corbusier (1887–1965). There is no freedom of panorama in France. The copyright length is 70 years, and the image can be undeleted in 2036.

These are some of the more elaborate interior architecture of the building. As France does not permit commercial Freedom of Panorama, these images infringe the posthumous copyright held by Le Corbusier's heirs, or heirs of the furniture and fixture designers.

I would save at least 08, 09, 14 and 17 as they show quite generic details or furniture under Commons:UA. --Sailko (talk) 15:15, 11 February 2024 (UTC)[reply]
@Sailko the #14 one is problematic. We see the relatively-artistic curved wall. I suspect it is also under Le Corbusier's authorship. JWilz12345 (Talk|Contrib's.) 22:39, 11 February 2024 (UTC)[reply]

Deleted: most as they show distinctive enough architecture. 14 and 17 show that too. Kept 8 and 9 because the architecture shown is too simple for a copyright. --Abzeronow (talk) 20:08, 23 April 2024 (UTC)[reply]

File:KKPark.jpg[edit]

There is no free license for FoP in Myanmar, and buildings are protected by copyright by default, unless it is an illegal building that would disqualify it from copyright protection, or the building is insignificant to the image itself. In addition, the completion of the front and rear construction of KKPark will begin around 2020. There is currently no indication that the building is illegal. Although the owner of the building is involved in multiple transnational crimes, it is still assumed to be a legal building in Myanmar and should enjoy copyright. Fumikas Sagisavas (talk) 23:37, 24 April 2024 (UTC)[reply]

Keep. I'm not convinced that there's any distinctive work of architecture visible in this photo. There's very little of the buildings visible, and what is visible is extremely generic. Omphalographer (talk) 01:30, 25 April 2024 (UTC)[reply]
